By accessing or using the website at mach5.gg (“Site”) or engaging Mach5GG LLC, doing business as Mach5 and Mach5 Digital (“Mach5”, “we”, “us”, or “our”) for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use this Site or our services. These Terms apply to all visitors, clients, and others who access the Site.

2. Services

Mach5 provides web design, web development, and digital marketing services (including SEO and SEM) under separate written agreements with clients. Nothing on this Site constitutes an offer to provide services or a binding contract. All service engagements are governed by a separate proposal and/or service agreement signed by both parties.

SEO and SEM services are available exclusively to clients whose websites were designed and developed by Mach5.

3. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, and code — is the property of Mach5GG LLC or its content suppliers and is protected by applicable intellectual property laws.

Work product delivered to clients under a separate service agreement is governed by the ownership and licensing provisions of that agreement.

4. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose or in any way that violates these Terms
• Attempt to gain unauthorised access to any part of the Site or its related systems
• Transmit any unsolicited commercial communications via the contact form
• Scrape, crawl, or data-mine the Site without our prior written consent
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Mach5 does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, Mach5GG LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this Site or our services. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed one hundred US dollars ($100).
